Wearable tech to revolutionise accident claims

A major aspect of personal injury cases is determining whether a victim deserves compensation for their injuries.

Currently a doctor is used to decide whether an individual has sustained injuries preventing them from working, but soon wearable devices could be used to inform this decision.

In Alberta, Canada, a law firm has made history by using a Fitbit (a wearable fitness device) to show what effects an accident has had on a client, the first time a wearable gadget has been used for the purpose in a courtroom.

The idea is that the victim wears the gadget for a period of time. The Fitbit will monitor the individuals' activity, providing quantifiable data which can then be used by solicitors. The data will be compared to a database showing average activity levels of people of the same gender, age and Body Mass Index.

Analytics firm Vivametrica claims that the method is non-invasive, and provides 'valid, objective, and individualised' information.

However this data will be used alongside other legal assessment tools, and will be only part of the puzzle when deciding whether or not compensation should be paid out.

If you have suffered an accident which wasn't your fault, contact our Wilmslow solicitors to find out if you may be owed compensation. You can speak to our team on 01625 522 429 or email info@richardsonlaw.org.uk.
