If you have been accused of possessing indecent images of children there are two laws which cover this area. Namely, the Protection of Children Act 1978 (PCA 1978) and the Criminal Justice Act 1988 (CJA 1988).
According to the PCA 1978 it is an offence if a person deliberately or knowingly took, made, permitted to be taken, distributed or showed indecent photographs of a child. Similarly if the pictures were distributed or shown or published that is an offence.
The CJA 1988 covers the possession of an indecent photograph of a child.
The maximum penalties for these offences range from six months' to five years under the CJA and 10 years under the PCA.
Furthermore offenders are subject to ancillary orders which includes signing the sex offenders register. And a Sexual Offences Prevention Order may apply which means a person is barred from engaging in certain activities with children.
Separately, in April 2015, the government introduced legislation that applies to people who distribute sexually explicit images without the subject's consent. This has come to be known as "revenge porn" and has been used for the purpose of causing embarrassment or distress to other individuals.
The person publishing the material can face a prison sentence of up to 6 months in the Magistrates Court and 2 years at the Crown Court.
If the offending images are of a person under the age of 18, further offences may be considered courtesy of the Protection of Children Act 1978.
