From the 25th June there will be major changes to employment law which as an employer or HR professional you need to be aware of.
Unfair Dismissal
In cases where an employee is claiming unfair dismissal for issues in relation to their political opinions or affiliations, the 2 year qualification period is not applicable.
Whistleblowing
Employees who make disclosures about their employers will only be protected if the information is in the public interest. The tribunal will decide if it is in the public interest and therefore the employee will only know if they are protected after the employment tribunal.
Disclosure & Barring Service
Last year the CRB (Criminal Records Bureau) was replaced by the DBS (Disclosure & Barring Service). From June 17th the DBS will introduce an update service which will enable employers to check an employee's status online and check for any changes. In order for an employer to access these "status checks" the employee must firstly give their consent.
If as an employer or an employee, any of these changes affect you or you need assistance with an employment law matter, call our team of employment solicitors at Ferdinand Kelly and we can provide you with the right advice.
