The leader of an organised crime gang has won a legal battle against deportation to his home country.
The foreign crime boss, currently living openly in the community in the UK, was the subject of a secret surveillance operation that uncovered his links at the top of a notorious crime gang.
The foreign national, who can only be identified as "Mr A", was detained on the orders of Priti Patel, the Home Secretary. He was set for deportation to a country outside the EU.
However, a secret ruling by three judges in the Court of Appeal has overturned the deportation citing "procedural fairness in respect of confidential matters".
Further comment was made, "Mr A" is married to an EU national living in the UK, and can therefore claim EU protection from deportation on the basis of his marriage."
The immigration and asylum upper tribunal had previously upheld the Home Secretary's deportation order, however the Court of Appeal overturned the decision. The case against "Mr A" is so sensitive that it is not possible to know the details of the reasons for overturning the deportation order, or even the man's nationality.
It can, however, be disclosed that the evidence was part-based on clandestine recordings of his activities and those of his family and associates, which linked him to guns, wealth, and revenge attacks.
Ms Patel vowed to speed up deportations and deter foreign criminals from entering the country. The Home Secretary said, "This Government's position on foreign national offenders could not be clearer. If you abuse our hospitality and commit crimes in the UK, we will do everything in our power to remove you."
