A Chesterfield woman has been ordered to remove her summer house and possessions after a dispute over land was ruled in her neighbours' favour.
Alison Bolsover, of Newbridge Lane, Chesterfield, removed the garden fence bordering her property in 1990, only to replace it with a new one 13 years late. However, the position of the new fence created a disagreement between Ms Bolsover and property developers Bruce and Irene Melville years later, after the couple purchased the neighbouring land.
According to Mr and Mrs Melville, Ms Bolsover had helped herself to a 20 foot by 90 foot wedge-shaped slice and changed the shape of her garden from a 'wedge' to an 'oblong'. Ms Bolsover hotly disputed this and also attempted to claim squatters' rights over the land, however, Judge Hefin Rees QC rejected the claims and handed victory to Mr and Mrs Melville.
Ms Bolsover later attempted to appeal the decision with new photographic and written evidence at London's Appeal Court but Lord Justice Longmore, who agreed with the original decision based on land registry documents and physical evidence, said:
"It does not seem to me that, even taking into account the new evidence, this is an appropriate case in which to grant permission to appeal."
