Airlines Can Dodge Bird Strike Flight Delay Claims

Thousands of passengers who had been anticipating payouts of up to £510 for flight delays caused by bird strikes may no longer be entitled to compensation.

 

The verdict comes from the European Court of Justice, which has ruled that a bird strike is an "extraordinary circumstance." This means that airlines can now reject compensation claims filed by passengers who were delayed by a bird strike.

 

Kevin Clarke, flight delay legal expert at Bott & Com, said:

 

"This is not the decision we were hoping for, but nonetheless it is clarity from the highest court in Europe who have found that bird strikes are an extraordinary circumstance.

 

"We are particularly disappointed because we have a track record of winning bird strike cases in the UK, even to appeal level. We'll be taking a long look at this judgment in the coming days to work out the best course of action for our clients and all UK passengers."

 

Other recent court decisions have extended the range of issues for which airlines must pay out, including when the aircraft is damaged by ground equipment, and occasions where a flight returns to the airport of departure.
