To explain matters first, Probate is simply a legal document that allows the assets in a persons "estate". ie. their net worth, to be distributed according to the instructions of the deceased.

There will usually be an Executor that's been appointed to act in the interests of the person who has died. That could be an individual or potentially a solicitors practice.

Such an Executor will have been nominated when the individual created their Will and then nominated the beneficiaries.

As a firm of solicitors, were you to instruct our Oxford team, we would value the assets of the Estate and establish who the Creditors are. ie. the debts owed to individuals, business and the tax man.

And after the debts have been settled then payment will be made to the beneficiaries listed in the Will.

It can be a complicated process but that's why you pay a solicitor to act on your behalf.
