Unfortunately there are many and various reasons why an individual might want to sue their solicitors. Due legal process may not have been followed, insufficient damages may have been claimed. ie. the client may have been due more. The list goes on.
One slightly off the wall attempt at litigation was detailed when a British woman attempted to sue her former solicitors for professional negligence. The suggestion being that her lawyers failed to explain, amongst other things, that getting a divorce would end her marriage.
The lady, who's a Roman Catholic, claimed her former solicitors failed to consider her faith and as such should have recommended a "judicial separation", which is a step away from a full divorce.
This story, as reported in the Independent, continues with the the suggestion that her claims were made against two separate firms of solicitors. A court had rejected the claims against the law firms but the lady appealed the dismissal.
Lord Justice Briggs, the presiding judge, said, 'The most striking of Mrs Mulcahy's many allegations of negligence against her solicitors was that, having regard to her Roman Catholic faith, Mrs Boots had failed to give her the advice which was requisite in view of her firmly held belief in the sanctity of marriage... either in terms of the alternative of judicial separation, or about the impossibility of pursuing divorce proceedings to a clean break settlement, without thereby inevitably bringing about the final termination of her marriage, which she wished to avoid.'
Her case was subseqwuently rejected by the court.
