Nabarro in Multi Million Pound Professional Negligence Claim

Leading commercial law firm Nabarro has been slammed with a £130m professional negligence claim by a disgruntled former client unhappy about the way it handled a High Court battle. 

The case scheduled to be six weeks long begins in November this year and proves to be one of the highest value professional negligence claims heard in recent history.

Nabarro were responsible for a series of cases in 2006 acting on behalf of former clients MCashback, founded in 2002 as their former colleague Paul Burtenshaw alleged 'wrongful diversion of a business opportunity together with fanmail.co.uk. The row erupted over shares and IP rights of the software company.

The tables have now been turned as Nabarro's professional conduct in their original defence of McCashback has been called into question and it is in fact Nabarro who will be in court this year charged with professional negligence.

Burtenshaw was previously one of four directors of a company called Dialtime, providers of free supermarket checkout airtime. When Burtenshaw's co-directors went on to set up MCashback the case was brought.

When MCashback plunged into liquidation in 2010, the directors appointed Nigel Tait of Carter Ruck to start the mammoth case against Nabarro. 

A spokesperson from Nabarro in an interview with www.thelawyer.com said "Nabarro will vigorously contest the claim being brought against the firm by liquidators of a former client named MCashback Ltd."

Potentially a landmark case for Nabarro when it tests a previous House of Lords decision on 31 July 2009 in the Stone & Rolls V Moore Stephens case detailing solicitors duties when presented with false client instructions.
