Barnaby V Raleys Solicitors

Former Coal Miner Mr Barnaby battled Raleys Solicitors in a professional negligence claim earlier this summer. 

Mr Barnaby worked for British Coal and developed a condition called Vibration White Finger during his working career. He was originally represented by Raleys and claimed compensation.

It was established that he was entitled to compensation due to various issues, not least needing assistance with several household tasks due to the severity of his injury. Raleys however advised Mr Barnaby to abandon this aspect of his claim.

That was the point Mr Barnaby contacted Mellor Hargreaves Ltd. He brought a claim against Raleys for the missed opportunity to recover compensation.

Of the total claims Raley's were dealing with it is understood that 63% of those miners were eligible to claim additional compensation. However only 20% of those claims were put forward.

Rayleys originally accepted the negligence claim, but later suggested the client was simply "trying it on"...

The Judge latterly found that proper advice had not been given and that there were discrepancies, within the original questionnaires, that a competent solicitor would have acted upon.
