If a loved one has died you will need to gain Probate as part of dealing with the deceased's financial matters. As such you may be comparing legal fees with a view to appointing a solicitor.
Obtaining Probate is the legal process of dealing with somebody's assets after they have passed away. As such the Executor of the Will is instructed to gain Probate and ensure that the assets of the persons Estate are divided accordingly.
If you are instructed to complete Probate on an Estate, you are legally responsible for making sure that all debts are settled and any necessary Inheritance Tax is paid. Currently, the threshold for Inheritance Tax is £325,000, however there are many factors involved in calculating the tax owed, including lifetime gifts.
We understand that this can be a difficult time for you and your family, so we will strive to deal with matters as sensitively and efficiently as possible to avoid unnecessary stress. We will do this whilst also being conscious that our fees should fit within your budget and have been fully explained.
Our probate solicitors are able to assist with:
Contentious probate (disputing a Will)
Gifts and the distribution of assets
Inheritance Tax planning
International assets
Trusts
Probate can take up to 12 months depending on the complexity of the Estate and that's one of the reasons to select your lawyer carefully and both check on their levels of experience but also confirm the costs and fees they propose to charge.
Please speak to our Welling probate team and we will walk you through the process and confirm what's involved in obtaining probate.
