A dad who sued his employers, Metrolink, for unfair dismissal could be handed more than £50,000 by his former bosses.
The dispute started in December 2014, when Metrolink sacked 50-year-old Stephen Morris for a "breach of confidentiality."
His dismissal revolved around a photograph that had been emailed to him in his capacity as a rep for the Workers of England Union. The photograph was an image of a manager's diary with details of a company reshuffle. The image had been sent to Mr Morris as colleagues were concerned about the way in which the restructuring was being handled.
After learning of the existence of the image, Mr Morris' bosses launched an investigation and found him "in breach of data protection," guilty of "gross misconduct" and sacked him.
Now, at a tribunal hearing, Judge Hilary Slater has ruled that Mr Morris was the victim of unfair dismissal. The judge concluded that Mr Morris had stored the information because of concern from union members, and had not shared the photograph, just mentioned it in a collective grievance letter. She added:
"I do not consider there was culpable and blameworthy conduct on the part of the claimant that contributed to his dismissal for this reason."
A spokeswoman for Metrolink RATP Dev Ltd, said:
"We're currently in the position of appealing the judgement and therefore we are not in a position to speculate or comment at this time on what is an ongoing case."
