Trip victim left with High Court bill

A woman who tripped over a kerb in hospital grounds has been ordered to pay the legal costs of the action against Dublin's Blackrock Clinic, which lasted four days at the High Court.

 

Tina Altman, who represented herself, claimed she suffered a head injury, pain in her lower back and neck, as well as headaches and arm pain, following the incident on June 29th 2006.

 

Blackrock Clinic denied that they were to blame for the accident, and argued that only Ms Altman was responsible for her misfortune.

 

Mr Justice Bernard Barton said that although there was no doubt that Ms Altman had suffered injuries, she had failed to prove her case in accordance with the law.

 

The court saw stills from CCTV cameras, but the images did not show clearly the cause of the fall. When awarding costs against Ms Altman, the judge ruled that the kerb and walkway were clearly visible, and there was no case for Blackrock Clinic to answer.
