A couple who paid £615,000 for a home in Surrey claimed they overpaid by £100,000 for the semi because they believed the sellers withheld information. They subsequently sued the sellers over claims they failed to tell them about "noisy" renters living next door
Both working in public relations, married couple Matt and Hannah Graydon, had bought the four-bedroom semi-detached villa in South Nutfield in January 2015, from husband and wife Mark and Lisa Crook.
Speaking in Central London County Court the Graydons stated that they were led to believe the house was occupied by "two elderly gentlemen who played with the kids in the snow".
They claim that by not telling them that the adjoining house had been converted to allow seven rooms to be rented out by tenants, the former owners had deliberately withheld information in order to "induce a sale".
The court heard that the Graydons were left unable to sleep because of frequent anti-social behaviour and "loud partying" from the renters with groups also gathering outside the house for "drunken sessions", which sometimes ended in violence.
Judge Nigel Gerald rejected the claim for damages made by the Graydons for alleged misrepresentation, and said that he was not convinced Mr and Mrs Crook had had the same experience when they lived in the house.
Lawyers representing Mr and Mrs Crook said that, in the 10 years they lived at the property the couple had never needed to call police because of disturbances. The Graydons are now facing a five figure bill for legal costs.
