An employment tribunal has ruled a former part-time judge is entitled to his full pension. This comes after he approached the Supreme Court after filing his original claim back in 2005 when he was told on retirement that he wouldn't receive his pension because it didn't fall within the scope of the regulations.
The tribunal found that O'Brien is entitled to a full pension and that he is entitled to compensation 'of an interest-like nature' because of the delayed payment of his pension and lump sum payable on retirement.
A judge noted that the case 'is the first of what is likely to prove a fairly lengthy series of hearings'.
