No Win - No Fee - Is This The Truth?

As the number of personal injury claims increases so the number of no win, no fee solicitors are on the rise but does the public truly understand this?

Litigation for personal injury sustained has come under the spotlight this month as Chief Ombudsman, Adam Sampson criticised the label no win, no fee and even suggested scrapping it altogether. 

In a recent report, the number of complaints received from clients about their no win, no fee agreements has spiralled.  The Ombudsman revealed that lawyers have been forced to pay out over £1 million in compensation to disappointed clients.

Some litigation experts have suggested that the no win, no fee tag could lead the public to believe this means, no fee at all regardless of the outcome of the claim.

A good personal injury lawyer should in fact made this statement plain and simple, if they use the term as part of their marketing tool kit then the client must be explained the risks.

Reputable law firms will set down the terms and conditions before they pursue a personal injury claim and inform the client of their choices.  There will be a fee to pay if the claim is successful.

The Solicitors Journal debated the issue when the report was published by the Legal Ombudsman and noted Sampson's comments that the report 'raised genuine questions as to whether the no win, no fee label should be used at all.'
